TERMS & CONDITIONS

 

 

The following paragraphs contain the general terms and conditions under which University Storage & Movers (USM) is engaged in the movement, transportation and/or storage of personal items including, but not limited to, appliances, boxes and packages within the United States or internationally and jointly through interchange with its partner companies. USM reserves the right to amend any portion of this service explanation at any time. Terms for the shipment of goods via our preferred shipper, FedEx®, can be found at www.fedex.com.

 

Other product and company names mentioned herein may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved to USM.

 

OWNERSHIP OF PROPERTY:

 

The consumer, herein called “Customer” has represented and warranted to USM that he or she is the legal owner or in lawful possession of the property and has the legal right and authority to contract for services of all of the property tendered, upon provisions, limitations, terms and conditions herein set forth and that there are no existing liens, mortgages or encumbrances on said property. If there be any litigation as a result of the breach of this clause the Customer agrees to pay all charges that may be due together with such costs and expenses including attorney’s fees which USM may reasonably incur or become liable to pay in connection therewith and USM shall have a lien on said property for all charges that may be due them as well as for such costs and expenses.

 

STORAGE SERVICES:

Sorry, but the following is a list of things that are prohibited from taking place, or cannot be stored, in any unit:

  • Anything that's stolen. Premises may not be used for any unlawful purpose.

  • No explosives, ammunition or dangerous chemicals.

  • No flammables, paint or oily rags. Gas tanks on cars, gas engines, etc. must be drained before storing in covered units.

  • No perishable foods.

  • No plants, animal or anything living.

  • No liquids of any kind.

  • Anything that leaks or makes loud noise.

  • No sleeping will be allowed in the unit.

  • Anything considered hazardous material by government authority.

 

Storage Services shall include the pickup, transportation, storage, and delivery of the Customer's possessions. The Customer shall present pre-packed personal goods to the USM at the time of pickup. USM shall transport these goods to a climate controlled storage facility chosen at the sole discretion of USM. USM will return the goods to the Customer during dates and times established by USM by considering school and dormitory schedules. Customer agrees to be present to receive the goods at the specified delivery date, time, and location.

 

The Customer understands access to goods in storage is not permitted. In acordance with this agreement, FREE PICK UP and DELIVERY are offered during "STANDARD PICK UP & DELIVERY" times provided. There is an additional $35 fee for all "NON-STANDARD PICK UPS & DELIVERIES".

 

Changes to the previously scheduled delivery date or location must be communicated by the Customer in writing to USM at least 48 hours prior to the earlier of the originally scheduled delivery date and the new delivery date. Changes not made within 48 hours of delivery are not guaranteed and an additional fee may be assessed. Payment in full is required within (10) days of storage PICK UP (beginning of contract). Unpaid balances may be assessed an additional fee of $50.

If Customer fails to claim thier items within thirty (30) days after the contract agreement has ended and has not made arrangements for a CONTRACT EXTENSION, the Customer's possessions shall be deemed abandoned, and USM shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the Customer. Customer shall be responsible for any costs incurred by USM in connection with disposal of Customer's property. USM will have no obligation whatsoever to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for services provided from the Customer. USM shall have no obligation to return any proceeds from the disposal of the Customer's property, and any proceeds in excess of the outstanding balance owed to USM under this Agreement shall be retained by USM as liquidated damages.

 

SHIPPING SERVICES:

 

USM shall act only as an intermediary for the receipt and forwarding of the Customer's shipping items to USM preferred shipping carrier (FedEx®). The Customer agrees to complete a Shipping Order (SO) provided by USM in a legible and complete manner prior to pickup of the goods by USM. USM will pickup and transport the shipping items to FedEx. FedEx will deliver the items to the address specified on the shipping labels after processing their pickup. FedEx will be used for all shipments. FedEx Ground or Home Delivery is the preferred level of service that will be used unless the Customer specifically requests and pays for an express service or international service. At its discretion, USM may choose to accept or reject the Customer’s items being shipped. USM is not responsible for any loss or damage to the Customer’s items if such loss or damage occurred during transport by FedEx. It is the Customer’s responsibility to file a claim with FedEx for damaged or lost items. Customer agrees not to ship items that are designated unacceptable by FedEx. A list of these items may be obtained by contacting www.fedex.com.

Customers who do not claim their items at the conclusion of the storage period and wish to have them shipped are responsible for all applicable charges. A minimum fee of $30 per box or item will be assessed. If items are not properly pre-packaged and ready for shipping, additional charges will be assessed.

 

PAYMENT:

 

Customer agrees to provide a credit card prior to or at the time of pickup/delivery. The Customer agrees to pay the total cost of the services indicated on the "Service Agreement". Pricing can be found on the USM Website, in the Pricing Section. The Customer further agrees to pay any applicable fees and charges as specified in the "Service Agreement" or on the USM Website. Fees and charges are subject to change at any time. Customer acknowledges that there shall be no refunds or credits provided to Customer, except as expressly set forth in this Agreement.

Customer must pay the total cost of the services at the time of pickup.

 

If the Customer pays by credit card, the Customer hereby authorizes USM to charge Customer's credit card within two (2) weeks of the pick-up date. In the event that a Customer's payment cannot be authorized all charges associated with this Agreement must be paid in full in order to receive your items before the time of their delivery, plus any applicable late fees or other applicable fees and charges. Denied credit cards will be subject to a $30.00 fee.

USM will have no obligation whatsoever to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for services provided from the Customer. USM shall have no obligation to return any proceeds from the disposal of the Customer's property, and any proceeds in excess of the outstanding balance owed to USM under this Agreement shall be retained by USM as liquidated damages.

 

 

ADDITIONAL FEES:

 

NON-STANDARD PICK UP/ DELIVERY: Items picked up or delivered outside of the STANDARD STORAGE DATES & TIMES are subject to a fee of $35.

OUT OF AREA DELIVERY: Items delivered to any off campus locations will be subject to a fee of $15 or mileage, which ever is greater. (Mileage=$2/ per mile between the delviery location and customer's school campus).

MISSED DELIVERY: If a customer is not available to have their items delivered during a regularly scheduled delivery time a $35 re-delivery fee will be charged.

FLEX PAYMEMT/PARTIAL PAYMENT/LATE PAYMENT: If a customer does not pay their balance in-full at the time of "Storage PICK UP" or within 10 days of 'Storage PICK UP" a fee of $50 will be charged.

CONTRACT EXTENSION: If a customer does not claim or make arrangements for their items by August 31th (the end of the contract period) they will be charged a $100 fee to extend their contract until September 15th of that same year. If customer does not claim or make arrangements for their items by September 15th of that same year, they will be an additional $100 fee to extend their contract until September 30th of that same year.  After September 30th of that same year if a customer does not claim or make arrangements for their items the Customer's possessions shall be deemed abandoned, and USM shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the Customer. The monthly CONTRACT EXTENTION rate for the months October -April is $100 fee per month.

 

 

PICK UP & DELIVERY:

 

USM establishes pickup and delivery dates and times. The schedule will be communicated directly to the Customer at time of sign-up and can be located on the “Storage Dates” page of the company website. USM reserves the right to reschedule such times without prior notice to the Customer. The Customer recognizes that USM will not be held liable for damage to their belongings after delivery has occurred. In the event that the Customer is not present during their scheduled delivery date and time, USM designated representatives can leave the customer's belongings inside or outside their room and USM liability for the Customer's belongings will cease. If absent during delivery, the signature of the USM designated representative making the delivery will evidence the delivery of the Customer's items in good condition. A rescheduled or missed pickup will result in additional fees as described in the Additonal Fees section of this document. Further, in the event that Customer is unable to be present during the pickup window or if the pickup location changes, the Customer must provide notice to USM one business day prior to the scheduled pickup date. Failure to provide timely notice will result in a charge to Customer of USM’s prevailing Missed Delivery fee of $30 for pickups/deliveries outside of the scheduled pickup/delivery time or date.

 

The Customer recognizes that only loss or damage caused by the negligence of USM will be covered by the USM declared value policy, as described in these Terms and Conditions. Only physical damage to the exterior of the item will activate any insurance claim on the item. USM will honor scheduled "Pick Up" and "Delivery" appointments but can not be held liable for damage caused by acts of nature such as rain. USM will take all precautions to prevent such damage.

 

Additional fees and charges will be assessed if the customer does not live on the campus of the college they attend. USM will assess such fees and charges dased on the distance form the main campus and the time it takes to travel to such location, according to USM's prevailing standard rates fro delivery and travel. In any event and in addition to any other applicable fees and charges, a minimum Out-Of-Area Delivery fee of $15.00 or mileage (which ever is greater) will be charged for any pick up or drop-off that is not on the main campus of the college they attend. Mileage rate is calculated at $1.00 per mile.

 

USM SERVICE GUARANTEE:

 

Concerning the Customer's shipping items, USM assumes no liability for the failure to make any specified delivery time or for the unsuccessful completion of delivery of the items or the contents thereof.

 

COMMODITIES HANDLED & RESTRICTIONS:

 

The guarantee does not apply if the failure to perform within the pickup or delivery window is due to causes beyond USM's control including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the stored items; acts of nature; public authorities acting with actual or apparent authority on the premises; acts or omissions of police or similar authorities; riots, strikes, or other labor disputes; civil commotions; disruptions in ground transportation networks, such as weather phenomena; and natural disasters. Since USM will act as an intermediary for our Shipping Carrier, the Customer must be advised that our Carrier holds itself out to transport general commodities, as usually defined, subject to the restrictions that are available at their Web site. The Customer agrees to familiarize themselves with the Carrier's restrictions prior to packing their articles for shipping.

 

USM provides storage services subject to a number of restrictions. The Customer accepts full responsibility and liability for any damages or losses that result from the Customer's failure to adhere to these service restrictions. No storage service shall be rendered:

 

a.  In the case of articles of unusual value, or of single packages having a value of more than $100 (U.S), or of collective packages having a value of more than $600 (U.S.) plus $100 (U.S.) per package.

b.  For items containing valuables such as jewelry, collectibles and currency.

c.  For hazardous materials and firearms.

 

d. For any items that are prohibited by law or regulations of any federal, state, provincial, or local government in the U.S.

e. For the transportation and storage of articles prohibited by USM’ logistics vendors

 

f.  USM will store but will not be held liable for items such as electronics that are not stored in their original packaging.

 

USM will not store or ship packages containing food or liquids, and the Customer acknowledges that they are liable for any damage their storage contents may inflict on the property of others. This includes but is not limited to bugs and or rodents attracted by food or liquids and or damage caused by leaking fluids.

 

USM reserves the right to refuse any package which by reason of the dangerous or other character of its contents is liable, in the judgment of USM, to soil, taint, or otherwise damage other merchandise or equipment, or which is economically or operationally impractical to transport, or which is improperly packed or wrapped. USM reserves the right to open and inspect any package tendered to it for storage or shipping.

 

INSURANCE:

 

USM automatically protects each USM storage and shipping order against loss or damage up to a value of $100. Order consists of all items stored or shipped on single invoice. Unless the Customer purchases insurance from an independent third party, the Customer agrees that the released value of the total order is no greater than $100 and that USM liability is limited to $100 period. To the extent that the Customer does not obtain additional insurance coverage for the full value of their personal property stored or shipped with USM, the Customer hereby agrees to assume all risk of loss, including damage or loss by burglary, fire, vandalism or vermin, acts of nature or terrorism. USM and USM agents, affiliates, authorized representatives and employees will not be responsible for, and the Customer hereby releases from, any loss, liability, claim, expense, damage to property or injury to persons that could have been insured (including without limitation any loss arising from the active or passive acts, omission or negligence of USM or its agents, affiliates, authorized representatives and employees).

 

Where the replacement value of the Customer's possessions exceeds $100 per package USM recommends the purchase of additional insurance. Additional insurance is available at www.collegestudentinsurance.com.

 

The Customer releases USM of any liability for damage to items with a carton, trunk or other casing without physical damage to the exterior. The Customer also releases USM of any liability for damages to items not stored in their original packaging or similiar. The Customer is liable for any damage their stored items may inflict on the property of others. All coverage is limited to the dates when USM has possession of the Customer’s items. A surcharge will be applied to customer’s bill for items not shipped in a box.

 

ABANDONMENT:

 

Without limiting the right of USM to conclude for other reasons that the Customer will not be returning to school, the Customer agrees that their failure to be present on the scheduled delivery day and their failure to communicate with USM concerning an alternate delivery arrangement constitutes abandonment of their stored possessions.

 

If Customer fails to claim thier items within thirty (30) days after the contract agreement has ended and has not made arrangements for a CONTRACT EXTENSION, the Customer's possessions shall be deemed abandoned, and USM shall have the right, but not the obligation, to take any reasonable action to dispose of any abandoned property, to recover any outstanding balance from the Customer. USM will have no obligation whatsoever to disclose information concerning action taken if any, and may still take necessary legal measures to obtain payment for services provided from the Customer. USM shall have no obligation to return any proceeds from the disposal of the Customer's property, and any proceeds in excess of the outstanding balance owed to USM under this Agreement shall be retained by USM as liquidated damages.

 

PACKING MATERIALS DELIVERY:

 

USM will make available packing materials one week prior to the move out week. USM will notify the Customer in advance of the dates, times and locations where materials can be picked up. It is the Customer responsibility to make arrangements to acquire packing materials during the dates, times and locations specified.

 

LIABILITY:

 

YOU HAVE FULL RESPONSIBILITY FOR, AND BEAR ALL RISK OF LOSS OR DAMAGE TO THE BOXES AND THEIR CONTENTS, AND FOR ANY DAMAGE CAUSED TO YOUR PROPERTY OR TO THE PROPERTY OF OTHERS BY THE BOXES OR BY THEIR CONTENTS WHILE THE BOXES REMAIN IN YOUR POSSESSION, INCLUDING WHILE THE BOXES ARE ON YOUR DRIVEWAY OR LOADING DOCK, OR IN ANY HALLWAY OR ANY OTHER COMMON AREA OF YOUR RESIDENCE.

 

SUBJECT TO THE SECTION ENTITLED INSURANCE, FOLLOWING PICK-UP OF YOUR BOXES FROM YOUR RESIDENCE UNTIL THE BOXES ARE DELIVERED TO YOU, USM DOES NOT ASSUME ANY RISK FOR LOSS OR DAMAGE TO THE PERSONAL PROPERTY YOU HAVE PLACED IN THE BOXES FOR STORAGE, NO MATTER HOW THE LOSS OR DAMAGE MAY BE CAUSED, EXCEPT FOR LOSS OR DAMAGE CAUSED DIRECTLY BY OUR GROSS NEGLIEGNCE OR WILLFUL MISCONDUCT, AND IN ANY EVENT USM'S AGGREGATE MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE FEES YOU PAID FOR THE SERVICES.

 

CUSTOMER SHALL DEFEND, IDEMNIFY AND HOLD HARMLESS USM AND ITS EMPLOYEES, AGENTS AND REPRESENTATIVES FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS, LIABILITIES, DAMAGES, COSTS AND EXPENSES.

 

APPLICABLE LAW:

 

This Agreement shall be governed by the laws of the State of Georgia, without regards for conflicts of law. If any part of this rental agreement is held to be unenforceable for any reason, in any circumstance, the parties agree that such part shall be enforceable in other circumstances, and that all the remaining parts of this agreement will be valid and enforceable. Unless otherwise stated, this Agreement applies to and binds the heirs, executors, administrators and assigns of the respective parties.
